A few months ago I wrote an article on Global Verged titled Global Verge Founders Pay $150K To Adult Escort Service Then Files Lawsuit For a Full Refund.

Although the facts of the original posts were accurate, I was wrong to title the post in such a way, as to question the personal integrity of the owners on such a personal basis.

For those who read the article, it was very clear, as to the facts of the situation. However, as we all know most folks only watch videos and may never read the documents. Which is another reason we have started using Scribd to post all documents.

Where is the final judgment from the courts. This is another huge win for Global Verge because they now have another personal with some assets to go after for damages.

Global Verge Wins Default Judgment Against Teonna K Poloa Escort Owner and Ben Piilani Partner

Global Verge Did Not Just Win Against Zer01 They Nailed Piilani Personally On Fraud

Well, as of June 8, 2010 the Clark County District Court granted the Order for Summery Judgment as requested by Global Verge against Zer01 and… Ben Piilani personally!

What makes this very interesting is the fact the order final Summery Judgment was ordered against Zer01, which could file for bankruptcy and Global Verge would never receive a dime of the money.

And, it was ordered against Ben Piilani PERSONALLY! When a fraud order is rendered on an individual, it stays with them for life. Ben Piilani can’t file bankruptcy and beat this judgment.

In other words, if Ben Piilani really is a billionaire, then Global Verge just won $43 million dollars. If the hype surrounding Pillani is false, then he will be chased for years as Global Verge follows the asset trail.

Now, here is the interesting part. Let’s say Pillani really did invent a new wireless technology platform, and he has just been waiting for the right partner to take it public. Global Verge may end up owning the patent for the technology, and at the end of the day the original Global Verge aka Buzzirk business concept could still happen. Crazier things have happened lately in the MLM wireless niche.

This judgment did bring to the surface some interesting questions:

1. What other MLM Wireless Companies are in the Global Verge cross-hairs?

2. Which former Global Verge Triple Diamonds or e-Assocates who are affiliated with above said companies as owners, directors, partners, officers, or founding distributors are also in the Global Verge cross-hairs?

3. What other former strategic partners and/or venders will be included in future lawsuits?

I believe any company run or owned by former top Global Verge e-Associates had better not count of luck to beat Global Verge’s legal team. They had better start looking for some serious legal counsel of their own.

Final Court Order Granting Global Verge $43 Million Dollars Against Zer01 & Ben Piilani Perosnally.

Breaking MLM Wireless News: Global Verge Wins Judgement Against Zer01 and Ben Piilani

Today, I had the opportunity to catch Brian Hardy of Marquis & Aurbach, the attorney of record for Global Verge, at his office. Mr. hardy has just gotten back from court, where his client Global Verge was awarded $43,981,313.00 in their lawsuit against Zer01.

I also had the privilege of meeting Ted Robbins for the first time over the phone.

Ted and I had a great conversation. He explained how frustrated, no down right angry he was at some of the things we had posted, and he was not sure he could trust me. Which if I were in his shoes I would probably feel the same way.

Long story short, by the end of the call, he agreed to an in-depth interview in the next week or so, and I agreed to do a five part series on Global Verge today.

Over the next few days I will go through all the old posts and find the important issues and see if we can get answers as to how those concerns have been addressed.

What I would like to ask right now is for current Global verge E-Associates to comment on this post and share with us any concerns you have which may need to be address.

I would also like current Global verge associates to share what they like about Global Verge. Tell us why you have stuck it out, and how you feel you have grown personally though all of this craziness.

Now there are two specific points I do want to clear up, which Brain Hardy and ted Robbins addressed on our call.

1. I and others across the net have alluded to the fact, by using an offshore processor, Global Verge and their owners “might” be stashing money in offshore tax havens, in case Global Verge went down. Ted and Brian were very clear, NO MONEY has ever been deposited offshore. All money was deposited in US banks, specifically BOA (Bank of America).

2. Ted Robbins also made it very clear, that through two of their business lawyers, they have addressed all complaints filed with the Attorney General’s office.

I am looking forward to talking with Ted and even Mark on the past, present and future of Global verge.

Global Verge and Zer01 Update By Nancy Gohring of IDG News Service

Nancy Gohring has followed this story since last year, and have done better reporting than anyone else I have come across.

Here is Nancy Gohring’s current article on Global Verge and Zer01 Mobile.

1. What has happened to Zer01 Mobile? Their website is gone, yet Ron Dresner just reached out to me in the last 30-days with some interesting info. Although, I can’t publish it yet, I am wondering if what he shared will be the end for some other folks.

2. Why hasn’t Zer01 Mobile answered their attorney’s plea for more information in their case? Could it be, the filing of this case was a ploy between Ben Piilani and someone(s) on the inside of Global Verge?

3. Why hasn’t Global Verge found it important to answer the 17 complaints filed with the Missouri AG’s office? Do they figure since the complaints are from former distributors that they are not important?

4. Why is Global Verge aka Global Mobile 1 telling folks on conference calls they are an MVNO? Yet on the Global Mobile 1 website under the FAQs it states the following:

“Q: Does Global Mobile1 have agreements with other carriers (i.e. AT&T, Verizon, etc.) so Global Mobile 1customers are not penalized for early termination of their contracts?

A: No. We have no agreements with any other service providers. It is completely up to the customer on what they do. We don’t encourage anyone to break their contract.

Q: If I am currently in a contract with AT&T, etc.,–what is the process of getting my service through GM1 instead? Do I have to break my contract so that when my number is ported over to Global Mobile1 my previous provider stops billing me?

A: We have no working relationship with any other carriers. GM1 can’t suggest to you one way or another what to do about your current contract. You will have to make that decision for yourself. Anyone can enroll in our service anytime by following the enrollment process.”

Now, we did not just stop with the Global Mobile 1 website, we also went to the telecommunication industry to see if Buzzirk Wireless, Global Verge or Global Mobile 1 was listed as a licensed MVNO.

Now at first we went to MVNOList.com well this site had not been updated since 2008, so we decided the info was old and outdated.

Next we went to Telecom Papers and looked in the USA, we did not find Global Verge, Buzzirk Wireless or Global Mobile 1.

So we kept looking and went to Telephulx and again we did not find any mention of Global Verge, Buzzirk Wireless or Global Mobile 1.

We even went to Wikipedia since so many other folks swear by it.

But, is it even important that Global Verge, Buzzirk Mobile or Global Mobile 1 is even an MVNO?

Understanding the MVNO value chain

Mobile network operator (MNO)

The traditional MNO is characterised by having their own mobile licence, their own mobile infrastructure and direct customer relationship to the end user. The MNO can handle Network Routing and will usually have roaming deals with foreign MNOs. The MNO can produce and distribute for example voice-minutes, SMS and MMS messaging and data traffic themselves. The MNO can typically handle customer service, invoicing and collect consumption data and handle handset management themselves. Additionally the MNO will usually handle marketing and sales to end users themselves.

Mobile network enabler (MNE)

An MNE is characterised by having their own mobile licence and own mobile infrastructure, but the MNE has – unlike the MNO – no direct customer relationship with the end user. It is therefore only an MNO that can establish themselves as an MNE. The MNE is capable of handling Network Routing themselves and the MNE will typically have roaming deals with foreign MNOs. The MNE is able to produce and distribute for example voice minutes, SMS and MMS messages and data traffic. The MNE will typically be able to handle customer relationship, customer billing and collection of consumption data and mobile handset management. The MNE will not handle marketing and sales to end-users, this is a task for the MNE’s wholesale customers.The MNE handles the technical side of the business and often also handles areas like customer service and legal assistance for mobile providers without their own network.

Mobile virtual network enabler (MVNE)

MVNEs are characterised by neither having a mobile licence nor mobile infrastructure or any direct customer relationship with the end-users. The MVNE is capable of handling Network Routing and the MVNE has typically entered into roaming deals with foreign MNOs. The MVNE is not capable of producing and distributing for example voice minutes and data traffic, but the MVNE will typically be able to handle producing SMS and MMS messages. A typical MVNE will handle customer service, customer billing, collection of consumption data and mobile handset management. Additionally the MVNE will not handle marketing and sales to end-users, this is a task for the MVNE’s wholesale customers. The MVNE functions as a middleman between the MNO and the mobile providers without their own networks. The MVNE handles the technical side and often also tasks like customer service and legal assistance for mobile providers without their own network.

Mobile shared spectrum enabler (MSSE)

The MSSE has no mobile infrastructure of its own, but is a technology provider that uses innovative hardware and software to enable MVNOs to create their own actual mini-networks, while preserving and enhancing the relationship between MVNO and MNO. Using its agreement with the MNO, and operating within the MNO’s spectrum license, the MSSE helps the MVNO to deploy its own network of low-power base-stations into areas the MNO could not justify, using Pico- and Femto-cell technologies. There is no impact on the MNO’s mainstream network and it can, if it chooses, extend the reach of the its network at no cost, while the MVNO can improve its profitability by offering specialist and niche mobile solutions.

Service provider (SP)

An SP has neither a mobile licence nor own mobile infrastructure, but the SP has the direct customer relationship with the end user. An SP is not able to handle Network Routing themselves and a SP will not enter into roaming deals with foreign MNOs. The SP is not able to produce and distribute for example voice minutes and data traffic and cannot produce SMS or MMS messages themselves. The SP will typically handle customer relationship, customer billing consumption data and handset management themselves. Additionally, the SP will typically handle their own marketing and sales to end-users.

Branded reseller (BR)

A BR has neither a mobile licence nor own mobile infrastructure, but has the direct customer relationship to end-users. The BR cannot handle Network Routing themselves and the BR will not enter into roaming deals with foreign MNOs. The BR cannot produce and distribute for example voice minutes and data traffic themselves and are not able to produce SMS or MMS messages. A typical BR will not handle customer service, customer billing or collection of consumption data and handset management themselves.The BR will primarily concentrate their activities around marketing and sales to end-users. The BRs’ positive contribution to the value chain is (naturally) their “brand”, but their distribution power will also be a central asset for many Branded Resellers.

Well, I guess we’ll all see what Florida has to bring this week.

Now I know that tonight’s headline comes on strong, so before everyone starts sending emails and making comments, I challenge you to listen to each recording, read the questions I ask, then decide what you think.

Ok, let’s get into the meat of this post.

Who is the New Global Verge CEO Steve Lewis?

Every legitimate MLM CEO I know or who I have read about has a bio which is published on the company site. And at the very least you will find it floting around the MLM profession.

Questions:

Where is the proof of who Steve Lewis really is?
What are the names of the 8 former MLMs he owned?

How Many Global Verge Distributors are really in the company?

(highlighted by MLM Help Desk) We are working feverishly to get everything aligned so that you are all paid appropriately.”

Questions:

Who’s lying… The Global Verge Staff member, or Steve Lewis?

On that note who is really lying to the field?

Questions:

What company launches without Policies & Procedures (guidelines) in place? Especially a company which is close to a year old? And whose founders have been trying to launch for three years?
If you can’t rely on the word of the corporate officers, then who’s word are you to rely on?
Since no one is really lying, yet no one knows what the guidelines are, then who do you go to for answers?
If the company was not planning on the field hitting critical mass so quick, why have they always talked about being a billion dollar company?
If the company is still being overwhelmed, then how in the same breach can the company be ready?

Why hasn’t credit cards been charged and commissions paid? Is this another lie, or a “not really” because 10 people whispered to each other until they got to Steve Lewis?

A little over a week ago, Steve Lewis said they would be starting to charge this week. Now he (THE CEO) doesn’t know when they will start charging?

Attention… This email just in!

“From: GlobalVerge
Date: Fri, Jul 24, 2009 at 10:05 PM
Subject: Global Verge CC Processing Update

All e-Associates:

We are pleased to announce our merchant processing integration is completed and charges are starting to process now under out larger expanded accounts.

What this will mean for everyone is that you will see charges on your credit card for any original June/July order or autoship starting from June 5th. In some cases you will see both June and July charged to your card.”

Now that is a GREAT UPDATE!

OK, now let’s look at this scheme to collect CASH for the phones instead of running them through the corporate merchant accounts.

Now, Steve Lewis just stated they only have 130 phones (Apple sold 1 mmillion 3G iPhones in 3 days in june, how is zer01 or Buzzirk ever going to get JUST their field force outfitted with phones if new reps are still coming in at 500 to 1000 per day?)

Here is the issue I have with what Steve just said. His statement is he does not want to overwhelm their new processors. Yet in the above audio he states there are over $3,000,000,000 dollars in pending charges waiting to be processed.

Well, if all he has is 130 phones and if they were $600 each (price of original iPhones), that will only be an additional $78,000. That is not going to “overwhelm” a processor or group of processors doing $3,000,000,000.

Questions:

How long are the processors holding the processed charges before they release to Global Verge checking accounts?
Is the first 15% to 25% of the charges going into reserve accounts to offset charge backs?
Why would the phones not be bought directly through the “private distributor” account of Buzzirk Mobile and delivered from Zer01 like other cell phone companies?
Is Buzzirk Wireless on a COD with Zer01, before Zer01 will delivedr phones or Sim Chips?

OK, now on to the New PR Firm for Global Verge. What legitimate company does not announce who their PR Firm is… Or worse yet, states “we have PR firms, then gives just the first name of one person?

Questions:

Who is, or who are the PR folks handling things for Global Verge?
Why is Steve Lewis so worried about his field force calling to verify what he tells them?

Now, let’ switch gears and look at something very interesting. Steve Lewis starts talking about all the other products of Global Verge. On the surface this is not out of the ordinary for a CEO to chat about. EXCEPT, 30,000 to 40,000 people did not sign up for those products they signed up for Buzzirk Mobile (Which by the way has been removed from the Global Verge Website… WHY?)

But wait a second listen to this next audio.

Questions:

Why bring in another new CEO?
Why bring in a “Dr” Scientist, if your main product is someone else’s cell service?
Who is Warren Hanchey (In my video I called him Wayne, that is my mistake)?
Is this the same Warren Hanchey who owns ZeroQuantum LLC8ight?
Is this the same Warren Hanchey who had issues at LightWave?

Since Steve Lewis would not tell folks how to spell the name who knows. Bus since Steve is all of a sudden talking up the other products it does make you wonder whats really going on.

Here is part of the recording where Steve Lewis talks about the commissions and when they are paying them out.

Although Steve Lewis has stated publicly that less than 700 people out of 40,000 have quit the company. There is no way to verify that information until the commission run is done and money flows to distributors.

I can say that Global Verge has given the distributors a chance to cancel their autoships before the cards were ran this week. This is a very positive move on their part.

Next week I’ll update on the commissions as word comes in.

Why would the CEO of Global Verge take on ACN, without first making sure his info was accurate?

False accusations against a company like ACN could cause more trouble than Global Verge has currently.

ACN, really is a multi-million dollar corporation, with real offices and high priced attorneys.
