New Seldia Chairman opens 2nd Round Table on the Future of Direct Selling

During the first week of October 2012, Seldia, the European Direct Selling Association in cooperation with the Italian DSA AVEDISCO hosted the 2nd Annual Round Table on the Future of Direct Selling in Milan. With over 150 participants the congress allowed the leaders and experts of direct selling companies and associations to debate the opportunities and challenges facing the industry.

For Seldia the event also marked the beginning of a new era with the election of Oriflame’s CEO Magnus Brännström as new Seldia Chairman for a two year term. Mr. Brännström opened the conference with his welcome address in which he stressed the importance of direct selling and of Seldia’s role as European trade association. 

In an interview given at the conference, Mr. Brännström said: “We are going to continue with the work that has already been started in terms of the lobbying and the PR activities that we have in Brussels, on the European level. Secondly we will make Seldia the support function for the local DSA’s, supporting in complying with the code of conduct and other local activities to do with EU legislation. And then, we would like to engage more corporate members on a European level. I think that we will see more and more pan-European activities. So for companies it is more and more important to think pan-European – and that’s where Seldia comes in.”

The Round Table event started on the evening of the 2nd of October with a Gala Dinner for all participants and with the Seldia Awards ceremony for Best DSA and Best Company of the year. The WFDSA, the World Federation of Direct Selling Associations annual meeting was held in conjuction to the Seldia Round Table at which Alessandro Carlucci, CEO of Brazilian company Natura and Chairman of the WFDSA gave an inspiring keynote speech at the main conference day on 3rd October. The conference included two panels, several guest speakers and an afternoon session of workshops.

EUROPEAN DIRECT SELLING

2012 Seldia Astra Awards Winners
This years Seldia’s European Direct Selling Awards for Best DSA and Best Company of the year went to the French Direct Selling Association (FVD) and to Oriflame. While for the FVD Jacques Cosnefroy (Managing Director) and François Failliot (President) came on stage to claim their award, for Oriflame it was Seldia’s new chairman Magnus Brännström.

The French DSA received their award for “for their successful efforts to promote direct selling at all levels by engaging in groundbreaking PR and education projects leading to the recognition of the industry as a credible method of distribution” and Oriflame won the Company’s award for “having helped to improve the image of direct selling in Europe and for its support to Seldia’s work”.

Seldia Executive Director Maurits Bruggink who led the awards ceremony stated in his concluding remarks that “we were very positively surprised at the large amount of nominations. It is important to stress that all of the nominees have done amazing work in the last twelve months and they are in fact all winners.”

New Corporate Member Joins Seldia

During the Seldia Annual General Meeting on 3 October 2012, Tahitian Noni have been elected as a new Seldia corporate member. As of 15 November Tahitian Noni will be known in Europe under the name Morinda (UK) Ltd. 
Morinda Bioactives, formerly known as Tahitian Noni International, is a direct selling company committed to the marketing and selling of natural medicinal plant bioactives. Morinda Bioactives is a private held company founded in 1996 with headquarters in Utah, United States.

Polish DSA organizes Direct Selling Day in Warsaw

On 16 October 2012 the Hotel Hyatt Regency in Warsaw was the venue of the Polish Direct Selling Day, a full day conference attended by 150 people, organized by the Polish Direct Selling Association (PSSB). The Association plans to make the Day an annual event in the future.

“What is… Direct Selling?” Video available now
Seldia in cooperation with Video Plus Europe have launched a video in which Direct selling is visually and dynamically explained. The video is especially suitable for DSA’s or individuals who would like to promote and inform others of direct selling and would like to do this through sharing this video. Upon request it is also available to Seldia member DSA’s and can be translated into the local language. The What is Direct Selling video can be found on Seldia’s Youtube channel.

EU AT A GLANCE

20 Years of EU Single Market
The EU is currently celebrating 20 Years of the EU Single Market which was established through the Treaty of Maastricht in 1992.It is one of the most wide-ranging and significant symbols of European integration, encompassing many of the policy areas where the EU is most influential. These include the European Customs Union, the single currency, the Schengen Convention and many other policies and laws designed to unite the diverse national economies of Europe into a single unit.

On another note the European Parliament’s IMCO Committee has unanimously adopted Regina Bastos MEP’s (EPP, PT) report on the 20 main concerns of European citizens and businesses regarding the functioning of the Single Market. The report found that EU citizens do not fully benefit from the Single Market and highlighted a variety of such examples. It suggests that stronger implementation of EU laws could be achieved through greater communication between Member States, enabling EU citizens to take advantage of the rights and services available to them. The report shows that the Single Market, albeit being a success story, is still very much in development. For more information, please click here

Seldia in Ireland

 

A Seldia delegation accompagnied by Paul Dobson, the UK DSA’s Code Administrator, visited Dublin on 19 and 20 September to meet with various stakeholders in preparation of the Irish EU Council Presidency which will start on 1 January 2013. Seldia met with Ministry representatives working on EU dossiers relevant to Seldia as well as with the EU Commission representation. Regarding the Irish EU Council Priorities, EU Affairs Minister Lucinda Creighton said in a recent speech that: “While the financial crisis will continue to remain a central concern for the EU, attention must now also turn to the challenge of getting the European economy back on track by improving the European Union’s global competitiveness, promoting economic growth and creating jobs.  This will be the central theme of the Irish Presidency and this national priority is shared by Governments and citizens across Europe.”Seldia also met with the European Consumer Centre (ECC-Net) and with the natonal Consumer Agency to present the industry’s code of ethics and the latest developments on Alternative Dispute Resolution, as well as with the Ministry for Gender Equality to exchange ideas on female entrepreneurship projects.

Upcoming Cosmetics Regulations
From 11 July 2013 onward, cosmetic products placed on the market of the European Economic Area are obliged to comply with the new European cosmetics regulations (EC) No 1223/20092, of which some provisions will be enforced beforehand. Replacing the old cosmetics directive 76/768/EEC, its main aim is to simplify and clarify the cosmetic requirements within the EEA market and to avoid divergences during the adoption process. 

The key changes will be on how nanoparticles in cosmeitcs must be specified on the product label with the suffix “nano”. All products and their ingridients will have to be disclosed on an EU database to ensure consumer safety and adverse reactions will have to be reported to national authorities so that the information can be made public. Furthermore to ensure even more safety, specific protocols have to be followed during safety and toxicology assessments. For a copy of the new regulation, click here.

Common European Sales Law
 The European Parliament’s Legal Affairs (JURI) committee met on 10 October 2012 to discuss their working document on the Common European Sales Law (CESL) which was published  8 October 2012. MEP Luigi Berlinguer (S&D, IT and Co-Rapporteur) said that they had reached a positive conclusion on CESL but he called for constructive and precise criticism rather than outright refusal from certain sectors. He mentioned that the doubts expressed during consultations, regarding unfair use of contract terms would be taken on board. He believes that the CESL could be improved in areas of distance selling to broaden the market. MEP Klaus Heiner Lehne (EPP, DE, Chair and Co-Rapporteur) argued that they will need to look at how CESL could be compatible with national law from a legal perspective. He mentioned that there is a consensus amongst the rapporteurs to see how CESL can be extended beyond SMEs. MEP Hans Peter Mayer  (EPP, DE, Rapporteur EP IMCO) argued that CESL should apply to all types of transaction not just cross border. He admitted that language is an issue; companies have different sites in different languages so the intermediaries do not always know what is going on. 

Next Steps: The European Parliament will hold an Interparliamentary Committee Meeting on “The proposal for a Common European Sales Laws: taking stock after a year” will take place on 27 November 2012, 15:00 – 18:30.

Data Protection
On the 9 and 10 October the European Parliament’s Civil Liberties, Justice and Home Affairs (LIBE) committee hosted an Interparliamentary meeting between the European Parliament and National Parliaments. The aim of the two day event was to hear concerns over the proposed Regulation on General Data Protection (processing and free movement of data) and the proposed Directive on Personal data protection (processing of data for the purposes of prevention, investigation, detection or prosecution of criminal offences or execution of criminal penalties, and free movement of data).The event, split into eight sessions, featured a multitude of speakers including the Vice-President of the European Commission and Justice Commissioner, Viviane Reding. Commissioner Reding stated that today, data is seen as a currency and thus should be able to flow freely. She argued that a lack of trust is a key barrier to the digital single market, with 70% of citizens believing that their data is being used for other purposes than stated. She insisted that a regulation was the only way forward since it would put an end to the fragmentation and ensure effective  enforcement of rules, unlike the current Data Protection Directive which has resulted in 27 different implementations of data protection rules, creating further administrative  burdens for businesses. 

 
EP IMCO Committee Meeting, Consideration of Draft Opinion on Data Protection Proposal 
The European Parliament’s Internal Market (IMCO) committee met on 10 October 2012 for the first discussion on the IMCO opinion on the proposal for General Data Protection Regulation drafted by MEP Lara Comi (EPP, IT). The IMCO report shows that the definitions are unsuitable, the term “data subject”  is too wide, “personal data” is too burdensome and definition of “consent” is inconsistent. The report proposes the deletion of the threshold for SMEs. Furthermore the call for a reduction of delegated acts of which there are too many and in some areas  unjustified. The Deadline for amendments to the IMCO opinion is 6th November.

New EC Staff Working Document on Consumer information and education
The European Commission issued a new staff working document detailing how it will refocus its actions in consumer information and education. As part of the drive to empower EU consumers, the staff working document on “knowledge enhancing aspects of consumer empowerment”  centers on awareness raising and capacity building of consumer associations. Through  examining the impact of awareness-raising efforts for consumer rights and redress, and investigating the best method of informing consumers on price, quality and sustainability comparisons this document also investigate a number key issues:

EC Consultation on Burdens for SMEs

Seldia will participare in the European Commission’s open consultation regarding burdens on SMEs. In the Report on “Minimizing regulatory burden for SMEs – Adapting EU regulation to the needs of micro-enterprises” (COM (2011) 803 final), the Commission announced that it would create a dedicated webpage to identify the TOP 10 EU legislative acts considered to place burdens on micro companies and SMEs. This will be used to make focused and tailor-made revisions of these legislative acts.
