Mark McCool and Mike Potillo founders of LiveSmart 360 (LiveSmart Three Sixty) may have cross the line in promoting their top earners on their YouTube Profile. Don’t get me wrong, these two MLM Pros are some of the best at branding and marketing. However, unlike the days of old, there are new rules in place which, when crossed can stop a company’s momentum in its tracks.

Here is an example of one of the videos.

Here is an article written by MLM attorney, Spencer Reese. In this article he shares my concerns.

MLM Deceptive Trade Practices – Spencer Reese

I also want to provide a copy of the current FTC Endorsement Rule, which also causes concern, since Donna Valdes is very clear there were only 6 top earners at the Leadership Retreat. If there were only 6 out of tens of thousands who joined Live Smart 360, then the income earned is not average or normal. Which means an income disclaimer should appear on each video.

Revised Endorsement Guides From The FTC

Now, I want it understand, I am not saying LiveSmart360 is a scam, in any way shape or form (at least not at this time.) However, now that the company is in soft launch, if they are going to protect their distributors, they need to be very careful on how much HYPE is used in creating the money stories, and promoting the Brand!

I am looking forward to reviewing this company and sharing more in the future.

Living An Epic Adventure,

Troy Dooly

Hey Troy since more and more people are rethinking and relearning facts about network marketing, do you see in the future more companies producing a Income Disclosure Statement like Monavie puts out. I know that’s the only way they can make income claims. Your thoughts?

    • Troy July 1, 2010 at 11:15 am #

      Concerned Network Marketer,

I do believe that more and more companies will start using the IDS (Income Disclosure Statement) as time goes by. The issue as I see it is most companies today are launching based on a compensation plan, instead of a needed product or service. In other words, the founders of the company are motivated by fulfilling their own financial need or greed. Based on this issue, they market based on money instead of a mission driven product.

If you look at some of the old and new companies who are hitting five to 35 years you see they were formed around a mission driven product or service… Primerica was formed after Art Williams saw his mom left with little life insurance and had to go back to work. Herbalife was launched after Mark Hughes saw his mom died addicted to diet pills. Mary Kay launched the company to empower women, PrePaid legal was launched after the founder experienced the rising costs of an unfounded lawsuit. Vemma was launched based on a product which could help give folks the needed vitamins and essential minerals they need on a daily basis. Life Force International was launched because Wayne Hillman was looking for something to relieve his wife’s pain.

But, lately we see companies launching based on the “Money Stories” alone. this is one of the main reasons I feel so many companies in the wireless niche, and in the energy drink niche are having issues or have already failed.

When companies “pre-launch” and start hyping HUGE income stories before a product is made available to the end user or even on autoship to the field, it raises huge red flags inside and outside the MLM Profession.

Income Disclosure Statements tell the truth. And if they have been fabricated, then the company will stand liable in a court of law.

        Troy,

I couldn’t be more excited to have just read your response to the concerned Network Marketer. When a product/company comes to market with clinical studies, competitve pricing, and ethical founders you can’t lose!

I don’t need to hear how much money someone is making. If you have an amazing product, it is easy to see the vision of working hard to build your own residual income!!

I was introduced to a new company (you have not reviewed them yet) about 8 months ago. I have been invited to join several companies in the past and never took a second look. I have always been interested in working from home, but have not seen a product or service that caught my attention until I saw the electronic cigarette from inLife.

I ordered an electronic cigarette for my mom about 8 months ago. It turned out to be network marketing. I did my research, met one of the cofounders and learned as much as I could about the company before I put my heart and soul into building a business. I have been very successful at helping smokers transition off tobacco onto the electronic cigarette. Just recently they launched a line of products.

Someone just recently introduced me to your site. I have been learning a lot about this industry as I meet other network marketers. It is such a shame that these companies are able to do this to people!!!

I am truly blessed to have found inLife.

Look forward to subscribing to your newsletter!

        Sincerely,

        Paula

I was gung-ho about LS360, but started to become disenfranchised by it when the comp plan wasn’t available until after or just before the initial sign-up date. I was also a little dissapointed by the startup pack, just some mist in an envelope, no FAQ, no in depth explainiation of the dual binary 2/3 compensation program etc. I dialed into the phone calls for several days and there was a lot of “we are going to turn Network marketing on it’s head” and not a whole lot of details for those beginning in network marketing.
I didn’t have the tools to speak knowledgeably about the company to the 30 people I talked to who signed up under the lock your spot campaign.

Lock you spot now this product changes everything real science no hype free to join free website and no website fee Launch on October 1st product can be purchased now get a head of the wave.

Troy, interesting that they now set the video to private, which I’m kinda bummed about. Donna V is a regular on a forum I participate on, or was until her involvement with LS360. She’s always been a class act and, from what I could tell, a wonderful leader. I hope the top dogs at LS360 do not get her or anyone else into trouble over their promotional material.

My mother signed up at their 300 person launch. I did some investigation and found out the so called research scientist behind this breakthrough technology is a scam…..calls himself a “doctor” but has a associates degree in sociology and some degree in exercise thereapy…..Product developed in about 2005 or before, he patent in 2005 and it was rejected in 2008 and therefore not patent pending as claimed. More importantly as you read the patent this life changing product is nothing put distilled water with about 15 trace minersals….people are buying a little spray in the mouth tube of this product…mineral water….for $40 a shot….will not last long. One of their own reps, a self confessed whistle blower investigated them and their products and inventor ‘dr shawn mueller’ and said stay away…she put up a site http://www.drshawnmueller.com.

      • mrx July 19, 2010 at 1:11 pm #

I’m not to worried about the product, we use homeopathy so the trace elements, and electrical signatures etc isn’t an issue for us. Many people don’t see this and they should really have tagged it as a homeopathic but they didn’t, that may have changed the veiw a little bit.

I’m still waiting for my commissions from the 1st run. I see the amount that is owed but it has not been paid yet. I was also eligible for share line commissions that were not paid. I was told by support they added my name to the list. I’ve been a top producer with another company in the past. As of now its hard to promote knowing I have not been paid yet. Its a couple of months late so far.

http://www.livesmart360.com it is a scam, I just got my refund from them. The only way you make money with lockyourspot is by buying many products and referring thousands of people to make any money with the real company behind it all http://www.livesmart360.com (what a scam.)

    • phillip July 20, 2010 at 11:42 am #

I been waiting for my May smartline commission. I been emailing them every week since the first week of June. All they can say is that it added my name to the list of people who didn’t get paid. It took over a month to receive my initial products. I ordered in May 21, 20010. Then i decide to email them and I they didnt send out my products til June 21, 2010. If i never emailed them they wouldnt have sent it. I’m really sick and tired of emailing them and trying to contact someone when no one ever picks up the phone. I’m really glad that i did not sponsor anyone in 360 I would have burn bridges, because this company is making me feel like i got scammed.

      • steve July 24, 2010 at 1:45 pm #

        Paul.

Sounds like I’m in the same boat as you. I do not believe they will ever pay it. Because this means they overpaid everyone in the shareline. I bet if we were one of the golden boys this would have been fixed quick.

What a way to be treated by a company. I’m always a 5 figure income earner in everything that I do.

STAY away from them if you are reading this……

    Hello,

I was with livesmart360 since the start. I sponsored 92 personals in just a few short weeks. Everyone that I bought into the business took 2 months to receive their commission checks.

They can parade around huge checks for their golden boys but not pay the average marketer.

No one in my group has received shareline commission either. We were told there was an error and not everyone was added to the list who was eligible.

I have placed numerous support tickets with the same email response “your name has been added to the list” you will see the shareline commission post soon.

I had to stop promoting this opportunity because of the way everything has been handled.

We have close to 1m volume in another company and never thought this would have happened in this company.

Another prelauch high in the sky dream I guess

    Hello,

livesmart 360 has been nothing but a hassle. Do a search online you will find numerous people who are still waiting for shareline commissions months later. I have contacted support time and time again to keep getting the “be patient your added to the list. It should not be to difficult to figure out a mathematical formula to pay those who missed out. What I do know is this means they over paid the majority of the people in this company. I doubt they will ever pay me the shareline commissions they way they have been handling this situation.

Livesmart 360 scam – Stay away find another opportunity.

I am so sorry for all who have been involved with this company. I have had the unfortunate opportunity to be a business partner with them in their past company. They have a pattern of not handling money correctly and you will probably never see your commissions. There are good companies in the MLM industry please don’t judge all by your experience at this company. Don’t give up on your dreams just move on quickl
