Today I talked with Kevin and he once again made it very clear, he had been contacted TODAY, and declined.

I am somewhat confused that an MLM company would launch without having their ducks in order. Why all the charades?

As most of you know who have followed our articles and reviews over the last few years, the following is the fundamentals all distributors should look at before joining any company.

1. Who are the owners of the company and can they be trusted to run the company? In other words do they know MLM?

2. Would you buy the product or service on a monthly basis if there were no compensation plan?

3. Are you willing to pay a monthly membership fee above and beyond your wireless bill to sell the services and earn commissions?

4. What type of compensation plan is being used, and what has history shown about this type of compensation plan?

Well, time will tell where this new company goes.

    Lexington, Kentucky – June 16, 2010 – In light of all of the recent investments scams including the infamous Bernie Maddoff, whistleblowers and those with morals fear that the frauds they expose will result in unjust lawsuits filed against them by the companies they complain about. One such situation was that of the lawsuit filed by Fortune Hi-Tech Marketing against Fortune Social LLC and Joseph Isaacs in May 2010.

    Joseph Isaacs and Fortune Social, LLC (collectively “Isaacs”) deny each and every claim brought by Fortune Hi-Tech Marketing, Inc. (“FHTM”) in a filing made today with the American Arbitration Association, who is overseeing this case. In addition, Isaacs fights back and asserts his own counterclaim for relief against FHTM, Paul C. Orberson (individually and in his capacity as President of FHTM), Jeff Orberson (individually and in his capacity as Chief Operating Officer of FHTM), and Thomas A. Mills (individually and in his capacity as Vice-President and Chief Executive Officer of FHTM) (collectively “FHTM”). Isaacs counterclaim claim Breach of Fiduciary Duty, Breach of Contract, Common Law Fraud, Unfair & Deceptive Business Practices, Failure to Register Securities, Fraudulent Practices Regarding the Sale of Securities, Civil Racketeering Conspiracy (violation of the Federal RICO statutes) and Defamation.

    FHTM operates an unlawful product-based endless recruiting pyramid scheme that relies on untrue and misleading representations and unlawful, unfair, and fraudulent business practices. While FHTM purports to be in the business of selling name-brand services like wireless, satellite television, home security, vitamins, nutritional products and travel services, its true business is using consumers to generate fee income for representing non-existent partnerships, major sports figures, and prominent businessmen. To entice consumers to participate, FHTM makes untrue or misleading claims regarding its relationship with Fortune 100 companies like Verizon Wireless, GE Security, Dish Networks and Travelocity to create the illusion that consumers can become millionaires in three to five years.

    FHTM’s growth exploded when it began to lure consumers disenchanted with traditional jobs and the recession that began in 2007 to inspirational and high-pressure business opportunity seminars touting an innovative business model that promises huge financial rewards through multi-level network marketing. FHTM erring presenters claim to have proprietary tools, special relationships, and other support that allow consumers to grow their own business by partnering with FHTM’s “companies”.

    It would not be long before Isaacs (and the world) made several troubling discoveries about FHTM’s business plan and practices that doused his enthusiasm: (1) Paul Orberson had not made any special arrangements with the companies mentioned at the business opportunity/presentation seminar or in the company produced videos; (2) the only way to earn a significant income and be promoted up the ranks was to recruit additional IRs; (3) FHTM had not received regulatory approval for its pyramiding scheme in every state; (4) only a handful of IRs had earned anywhere near the residuals projected; (5) the prominent businessmen, politicians, former attorney generals and sports figures to whom FHTM constantly alluded were in fact IRs actively promoting their own FHTM business; and (6) a growing number of state attorneys general had already begun investigating FHTM in response to numerous complaints.

    It turns out that FHTM’s ‘innovative’ marketing plan is nothing more than a face lift to an age-old scheme. According to the FTC’s Consumer Protection Bureau:

    Pyramid schemes now come in so many forms that they may be difficult to recognize immediately. However, they all share one overriding characteristic. They promise consumers or investors large profits based primarily on recruiting others to join their program, not based on profits from any real investment or real sale of goods to the public. Some schemes may purport to sell a product, but they often simply use the product to hide their pyramid structure. There are two tell-tale signs that a product is simply being used to disguise a pyramid scheme: inventory loading and a lack of retail sales. Inventory loading occurs when a company's incentive program forces recruits to buy more products than they could ever sell, often at inflated prices. If this occurs throughout the company's distribution system, the people at the top of the pyramid reap substantial profits, even though little or no product moves to market. The people at the bottom make excessive payments for inventory that simply accumulates in their basements. A lack of retail sales is also a red flag that a pyramid exists. Many pyramid schemes will claim that their product is selling like hot cakes. However, on closer examination, the sales occur only between people inside the pyramid structure or to new recruits joining the structure, not to consumers out in the general public.

    Nonetheless, the truth is catching up with FHTM. On December 10, 2009, The North Dakota Attorney General's Office filed a Cease and Desist Order for violation of the Consumer Fraud Law, the Transient Merchant Law, the Home Solicitation Sales Law, and the North Dakota Pyramid Schemes Act. On January 19, 2010, FHTM entered into a Assurance of Voluntary Compliance with the North Dakota Attorney General's Office. On March 16, 2010, the Montana State Auditor's Office filed a Temporary Cease and Desist Order against FHTM, Paul C. Orberson, Thomas A. Mills, and Dianne Graber (a Montana IR). According to the Montana State Auditor's Office, FHTM has engaged in acts or practices constituting violations of the Securities Act of Montana, Montana Code ANN.30-10-101 et seq. On April 22, 2010, FHTM agreed to pay nearly $1 million and to change its business practices to resolve the charge that it is operating a pyramid promotional scheme.

    With each passing day, more states are jumping on FHTM’s bandwagon. The alarming rise in consumer complaints and governmental sanctions has prompted the Better Business Bureau of Central and Eastern Kentucky to downgrade FHTM’s rating from “B-” to “F”. At the same time, a proliferation of online bulletin boards and blogs, such as http://www.complaintsboard.com and http://www.scams.com criticize FHTM’s pyramid scheme confirms that Isaacs’ experience is not unique. Will those operations be the next target of Fortune’s high price legal team?

  5. Kevin, I am not trying to attack your character, but I believe you may be slightly mistaken, at least from my view point based on our previous conversation. You told me that Chris Grecco was "Blacklisted from MLM". I asked what you based this on, and your response was " Go look at Troy Dooley's latest blog". Now that blog was coupled with an audio where he addressed DNA reps and I think an owner or corporate officer of DNA. You also referenced "red flags" in our conversation and did say DNA affiliation among others that you stated in another post. No I do not have this taped, and no I am not trying to harm your name, just stating parts of our conversation when I called you seeking confidential legal advice on policy and procedures which as you stated to Troy and on this blog, you declined. If I am mistaken I will accept your correction, but this is how I remember our conversation. Now I must admit, that I do not believe that your decision to decline working with us, was based on you having any personal ties to DNA (I am sure you do not, as you stated above).

    I'm so tired of people talking about the poor reps at DNA. Everybody keeps talking about how Phil is lying and scamming 100,000 DNA reps. Did anyone even ask the reps? Most of us heard the story of Phil months ago and we decided to stay and see what happens. DNA had been a blessing to all of us until Chris came along. So needless to say if you see how many of us are still here and how many of us are joining everyday you will see that we are fine at DNA because we have seen no evidence of Phil doing anything to anyone. Those companies that failed Phil was a victim too. So Chris you can stop trying to get the world to focus on Phil (old news) and get your own act together. I feel sorry for the poor reps that keep following YOU!

    Based on your statement above "Anyone who feels they need to HIDE behind another name is Wrong." Maybe you are right… I bet Agnes Gonxha Bojaxhiu had something to hid, and was wrong in going by her pseudonym. Neither you or I can decide for another person why they go by a different name. Why don't you go talk to some Jewish WWII survivors and condemn them for going by a pseudonym.

    Seriously, this isn't about piccolo, this is about an organized group of people going from company to company with the intent (according to their leader Chris Greco) with the intent of dominating the MLM Wireless Niche.

    Let's take a look at a few people who have used pseudonyms, and ask why? I'm sure they all had a reason in their own mind for the need. By the way I did my best to follow your lead, and leave out movie stars, song writers and dance show, and writers. I listed Business Leaders, Religious Leaders, Doctors, and Heads of State.

    As for the Mark statement… Let's not go down that road. Mark had no choice even if he had wanted to use a pseudonym.

    ROFLOL… My agenda is with DNA? Yep, you need to watch the next post. Although it will not change how you think, it does focus on your limited belief.

    By the way, how do you know DNA is bleeding reps?

    By the way, if I am not mistaken it Rod Cook and ted Nuyten who broke the news on Piccolo, not a scammer. Get your facts right. And, if you were paying attention, you would realize we have been on the same page from day one with ted and Rod on Piccolo being with DNA.

    I wish you the best of luck in the future. I would like to advise you of the importance of maintaining your composure. It's the sort of strong rhetoric that you post that leads to animosity and trouble. Also, I viewed one of your sentences as a question on my character.

    There's nothing "interesting" about it, Chris. Me saying "no" to your company has nothing to do with DNA. I really have no clue about their business and I have zero ties to them. Men of integrity expect to be believed and when they're not they let time prove them right. So calm down, build your business and see what happens over time.     1. You have a great point on Monopolizing an industry. However, MLM is a profession, and one that is in constant change. And I still stand by my main red flag in the Wireless niche… There are four companies which control all the others. As long as they are in a price war, the money going to distributors will continue to go down, or the companies will have to come up with creative ways to pay high commissions. It will be interesting to see what happens if the FTC, SEC or FCC gets in the middle of things.

    2. Chris the recording on Kevin was on the same call, where you state the company "Global Pros" had already formed and have 9 owners. I'm somewhat confused, can you explain a little more in detail?

    3. Kevin did not want to talk with you. You asked me who was the best MLM Attorney (I have the emails) and I said Kevin Thompson. You talked to him once, and never called him back.

    4. Which friend are you referring and which company? I am friends with most of the CEOs and founders of the wireless companies.

    6. Chris, it seems you and others have not followed DNA from the very beginning. If you had, then you would know the world already knew Phil Piccolo used the pseudonym (which is common business practice in several industries and niches) Warren Anthony, and has for years. This is nothing new to this community or the MLM world. As for why we have not focused on that side of things, is because it just isn't the important issue. What is important about Phil Piccolo is discovering valid documented evidence that Piccolo is the leader of an international organization focused on stealing peoples money. If you or others can provide this documentation, then we can turn it over to the Organized Crime Task Force of the FBI and have them charge Piccolo and his crew with RICO violations. At the very least folks might be able to hit him with a class action lawsuit.

    7. I look forward to watching the AG website to see when they charge Phil. By the way which AG office are you referring? If it is Florida I'll call and chat with them personally.

    thank you for commenting on this issue. Let me address where we stand on this issue.

    1. We obtained the recording legally from a public site, sent to us by the owner of the conference call bridge.
    2. Under privacy laws in Florida, because more than one person was on the call, the call is not classified as private.
    3. Under constitutional law, we have decided to keep all the recording public.
    4. Since you have initiated legal action, I am sure we will be called as witnesses so we will cross that bridge in the future.
    5. Time will tell, and I look forward to watching the continued launch.
    6. As for the MLMWirelessNews.com site… Like DNA it is listed as a private registry, makes one wonder who the real owner is and what the hidden agenda is all about. But should be a good show.

    4. As for the Piccolo issue, this is not new news. From the very launch of DNA it has been public knowledge that Warren Anthony is a persona used by Piccolo. As a matter of fact we reported on this issue and linked to Rod Cook and Ted Nuyten's sites. I have not taken down any of our posts on Piccolo. I do have a question since you have 14 years in law enforcement… Under what law is using a pseudonym illegal? This is common business practice in just about every niche and industry I know of.

    5. Chris needs some close friends around him. I guess this is the same thing George is doing for Phil. Seems you and George have a lot in common.

    8. ROFLOL… Why don't you link the audio so everyone can heat the full context of whatever audio you are referring? I have had many conversations with George, Phil and several others CEOs of wireless companies over the last few weeks. I have nothing to hide feel free to post it.

    9. As for proof of and conversations with a "Juice company" ROFLOL… There are hundreds of juice companies. Go ahead and tell us the name of the company and the person who is representing that company. Then I'll call the CEO and ask him about it. Either put up or shut up.

    I'm not sure where in this audio you can possibly surmise that Greco is saying Global Pros has already hired Kevin Thompson. The speaker asks who they are going to sue and Greco replies 'Kevin Thompson." It would have been different had he asked "Who IS the MLM attorney?"

    A bit of a stretch and certainly not front page newsworthy…

    Thanks for posting. This is an interesting drama that's playing out. It reminds me of the analogy where three blind men were feeling around a large creature. One said the creature felt like a snake. Another said it felt like a tree trunk. The last blind man said it felt like a spear. After they all got together and talked about their experiences, they soon figured out that they were dealing with an elephant. Troy, it seems that you've done a good job getting all us folks together and putting the pieces together. We all had a different experience with Chris and when you step back and connect the dots, it makes for an interesting story.

    I cannot speak about the personal character of Chris Greco, although I do smell quite a bit of foul play. I should apologize for using the word "punk" on my facebook status. I've been known to be impetuous at times and when I saw the story unfold, I got angry. Calling him a punk was inappropriate. Still, there are waaaaay too many red flags associated with this endeavor for me to work with their company as its MLM attorney. With words like "Global Verge, Greco, matrix/binary, telecom, MLM," it seems like the ingredients for a host of problems. Historically, telecom companies have gotten in trouble in this industry due to the fact that the margins are low. With low margins, companies resort to "training bonuses" and other machinations to beef up the compensation plan circa Fortune High Tech. In addition to some of my initial reservations, there's a doom cloud looming over Chris Greco and they haven't even launched the business yet, which either takes a lot of skill or a series of bad decisions. PLUS, Greco has managed to agitate some of the larger juice companies in the industry like MonaVie and Vemma…he's certainly struck several nerves in a short amount of time.
